Navigating the complexities of whistleblowing

In today’s operating environment, it is more critical than ever for companies to ensure they are managing their whistleblowing programme properly and credibly. Companies need to ensure that reports are triaged and addressed efficiently, effectively and with due process.

In the context of the dynamic landscape of technological change, regulatory challenges, and the evolving role of the GC this session will explore whistleblowing and the challenges of achieving these objectives.

We will explore the role of regulators and the ideal relationship a GC should put in place with them. This will include the increasingly pivotal role of the GC as a Corporate Conscience or Chief Integrity and Ethics Officer and the potential for a new role, perhaps a ‘Corporate Whistleblowing Officer’? This opens the debate on the necessity of such a move and should GCs be expected to fulfil this role?

Alongside this, we will consider how to manage the impact of whistleblowing cases on all those involved in handling a concern – maximising psychological safety and individuals are treated with humanity, respect and fairness.

The session will discuss how GCs deal with typical scenarios such as, ‘Who are we as an organisation?’, ‘How do we manage complex and often conflicting risks?’ and ‘What are we willing to get behind?’.
